We understand that customers may have concerns about the privacy of the Personal Information they provide. 

We, PT Asuransi Bina Dana Arta, Tbk (“Oona” or “we” or “our”), believe that a person’s Personal Information (“you” or “your”) must be treated with the utmost respect and we are committed to protecting your privacy and confidentiality. 

It is important to us that you have trust and confidence in us that your Personal Information will be treated with the highest level of privacy and protection. Our goal is to ensure that your Personal Information is handled in a responsible and reliable manner, and at all times in accordance with Law no. 27 of 2022 regarding the Protection of Personal Data [JDIH BPK RI] LN.2022/No.196, TLN No.6820. This Privacy Policy serves to help you understand what and how we collect, use, disclose and store your Personal Information. 

By submitting information to us, registering for any product or service offered by us, you are giving consent to us and our affiliates and related companies (collectively, the “Oona Group”), and their respective representatives and/or agents (“Representatives”) collect, use, disclose, share and transfer among themselves your Personal Data, as described in this Privacy Policy. 

1. What types of Personal Information are collected? 

The term “Personal Information” refers to data, whether true or not, about an individual who can be identified (a) from that data; or (b) from those data and other information to which the organization has or is likely to have access. 

The Personal Information we collect or may collect includes: 

  • name, telephone number, email address, residential address and correspondence address; 
  • identity card or passport number and birth data; 
  • occupation, gender, marital status, education and income level; 
  • in connection with certain products or services, such as when providing insurance, we may collect sensitive information about your health and medical history depending on the type of service provided; 
  • financial, banking and payment information, for example, when you purchase certain products or services through our website, we may collect your credit or debit card details; 
  • personal opinion that you have expressed to us, for example, through a survey or feedback response; 
  • browsing history, patterns or other unique information (including information collected by cookies on our website, such as the pages you clicked on and viewed, your location, the type of device you used to access our website, information you may have entered and send us via our website, and the number of times you visit our website); 
  • your internet protocol address and information associated with that address; 
  • records of your contact with us such as via our customer service center telephone number and, if you contacted us online using our online services or via our smartphone application, details such as your mobile phone location data, IP address and MAC Address; 
  • products and services, which you hold with us, and which you are interested in and have and the associated payment methods used; 
  • use of our products and services, any claim and whether or not the claim was paid (and details related to this); 
  • analysis of marketing-related data created for you, including the history of communications and whether you opened them or clicked on links; 
  • information we obtain from third parties, including information about insurance risk, prices, claims history, cases of suspected fraud, and usage history; 
  • personal information we obtain from Credit Reference Agencies and Fraud Prevention Agencies, including public (for example, defaults) and shared credit history, financial situation and financial history; 
  • fraud, debt and theft information, including details of money owed by you, suspected cases of fraud or theft, and details of any devices used for fraud; 
  • criminal record information, including alleged offences; 
  • information about your property, such as location, value, number of rooms, property type, and any building work you have done (if relevant to the product or service); 
  • financial details about you, such as your salary and other income details, your savings details, your spending details, and payment methods; 
  • information about your employment status (if relevant to the product or service); 
  • information about the occupant status of your property, such as whether you are a tenant, living with your parents, or an owner of the occupants of the property where you live at the time of application; 
  • information we purchase or rent from third parties, including demographic information, financial details outstanding, marketing lists, publicly available information, and information to help improve the relevance of our products and services; 
  • insights about you and our customers obtained from customer analysis or profiling; 
  • third party transactions; such as when someone other than the account holder uses the service, information about that person and their transactions; 
  • Other Personal Information that is reasonably necessary for us to provide the product or service requested by you; 
  • any other Personal Information permitted by or required to comply with national, state or local laws, rules, regulations, notices, circulars, directives, guidelines, guidelines, codes, guidelines and/or government regulations any local or foreign authority, or any other authority whether in Indonesia or elsewhere, whether having the force of law or not, as may be amended from time to time (“Applicable Law”). 

At any time, we only collect Personal Information on a “need to know” basis and for the Purpose of providing our products and services to you. 

2. How do we use it?

  • fulfill our obligations in connection with providing products or services to you; provide you with the services and benefits of your insurance policy, assess, process and pay claims; 
  • following up and assisting you with the implementation of our products and services; we use internet technology to track your use of our website and information filled in by you, whether submitted or not; 
  • processing, issuing your policy order and sending by word and your policy certificate by fax, post or email; 
  • contacting you for service administration purposes in relation to our products and services, for example, we may want to notify you that a certain service has been suspended for maintenance. We want to underline that you will not be able to unsubscribe from these communications as they are considered part of providing our services; 
  • carry out due diligence, including conducting APU/PPT inspections and examination of sanctions in accordance with Applicable Law; 
  • conduct market research for business insights, and perform statistical analysis and profiling; 
  • conduct surveys and solicit feedback for quality assurance in order to improve the quality of our products and services; 
  • provide general information about our products and services, including but not limited to providing media announcements, promotions and product discounts; 
  • facilitating potential acquisitions or mergers with other organizations, or after acquisitions or mergers with other organizations; 
  • facilitate any upgrades to our system infrastructure and business operations that enable us to provide you with better service in relation to your insurance policy; 
  • in connection with Cookies, improve the quality of the services we provide to you. Cookies are small text files containing information that are stored by your browser on your computer’s hard drive and can be used by website operators to identify users and collect Personal Information; 
  • facilitating and managing business operations, including but not limited to disaster recovery, data entry, and data storage; 
  • respond to, handle and process your inquiries, requests, requests and complaints; 
  • exercise any rights and obligations that we and Oona Group may have in connection with the provision of our products and services, including but not limited to audits, compliance and investigations; 
  • training and security purposes in relation to recorded phone calls;

 4. To whom do we disclose your Personal Information?

  • any of our shareholders or related companies, and any of their successors or assigns, and their directors, officers, employees, Representatives, agents or delegates; 
  • employers, contractors and agents of Oona and other members of the Oona Group, who may be given access to any Personal Information we collect, but their use is limited to the performance of their duties in connection with the products or services provided by us; 
  • any service providers, agents, contractors, delegates, suppliers or third parties (or subcontractors of the former parties) that we may appoint from time to time to provide the services or services we offer to you, and their directors, officers, employees, Representatives, agent or delegate; 
  • business partners (including reinsurance companies, brokers and bank partners), partners and third party service providers if reasonably necessary, and on a “need to know” basis; 
  • any person who takes over or can take over all or part of our rights or obligations under this Agreement or anyone who is transferred or can be transferred to this Agreement (or any part thereof); 
  • to other entities in the event that Oona is intended to be acquired by or combined with, or acquired by or combined with such other entities; 
  • in the case of motor vehicle insurance policies, to other parties in the case of accident claims where you do not exchange information with these other parties. Such information may include your or your driver’s address and name; 
  • any relevant governmental or regulatory authority upon request by the relevant governmental or regulatory authority, or any person to whom we believe in good faith, is obligated to make disclosures as required by Applicable Law; And 
  • parties who assist us in carrying out the Purposes described above in this Privacy Policy. 
  • our professional advisers, consultants and auditors and anyone we believe in good faith to be your legal adviser or other professional; 

Other than as required or permitted by law or pursuant to a court order or as provided for in this Privacy Policy, we will not disclose, share, rent, sell, or trade Personal Information to any third party without your permission. If we have disclosed your Personal Information to third parties, we will ask those parties to protect your Personal Information in a manner consistent with this Privacy Policy. These third parties are not permitted to use or process Personal Information for any other purpose except as permitted by us. 

5. Marketing 

If you give us your express consent to use your personal information for marketing purposes, we will use your personal information for marketing and promotional purposes including but not limited to conducting lucky draws, or other information that you may be interested in, with the intention of improving product quality and our services and generate business. 

If you have requested not to receive marketing materials or communications from us, or other communications for promotional purposes, we will not send them to you. You have the right to change your consent to marketing preferences at any time. Your withdrawal consent for marketing will take effect within 30 days of receiving your request. However, such withdrawal will not affect our provision of the products and services that you have requested from us. 

6. Transfer of your Personal Information outside Indonesia 

If permitted by law, we may transfer, store, process and/or handle your Personal Information outside of Indonesia. As such, we will comply with all applicable data protection and privacy laws, including Law no. 27 of 2022 regarding Personal Data Protection. 

7. What security do we use to protect your Personal Information? 

Oona considers the security of our customers’ Personal Information to be an important and necessary part of our responsible corporate data management. Therefore, we take all reasonable steps to ensure that customers’ Personal Information is secure and protected against loss, misuse, unauthorized access, modification or disclosure. All information is stored on a specially designed database for our exclusive use. 

To fulfill our obligations, we follow strict security procedures for storing and disclosing Personal Information to prevent unauthorized access to it. 

8. Personal Information Storage 

Your Personal Information is retained as long as the purpose for which it was collected persists and until it is no longer needed for other business purposes or to comply with Applicable Laws. 

9. Access and Correction of Personal Information 

It is important to us that your Personal Information is accurate, complete and up to date. You must ensure that you provide true, accurate and complete information. By applying for insurance with Oona by telephone, website, email, fax or newspaper, in accessing and using our company website, you consent to the collection, use, disclosure, storage, processing and transfer of any Personal Information that you provide to us in the manner described in this Privacy Policy. Any prior consent given by you will not be affected by the termination or expiry of your insurance policy. 

You can withdraw your consent to the collection, use, disclosure, storage, processing and transfer of your Personal Information at any time by contacting us according to the details provided above. Withdrawing your consent will take effect within 30 days of receiving your request. Furthermore, we will stop collecting, using, or disclosing your Personal Information, unless required under Law no. 27 of 2022 regarding Personal Data Protection or other written Applicable Laws. 

Please note that if you withdraw your consent, we may not be able to provide the service you requested and we will notify you of the consequences of withdrawing your consent if applicable. 

10. Update Notices 

We reserve the right to change, modify, update, amend or update our Privacy Policy at any time, by notifying you of the updated changes. We will post these changes on our website so you are always aware of what Personal Information we collect, how we use it, and under what circumstances we disclose it. We also encourage you to periodically review the Privacy Policy to find out how your Personal Information is being protected.
